Processes relating to guardianship, trusteeship and restriction of legal capacity are aimed at protecting the person and the assets of those who have difficulty in managing their own affairs. The decisions given in this area directly affect the person’s capacity to act; the balance between the need for protection and the autonomy of the person is struck separately in each file.
The work is conducted by addressing together the existence of the ground for restriction, the medical board report to be obtained, the identification of the person to be appointed as guardian and the arrangements for the administration of the assets. Which of the transactions to be carried out by the guardian are subject to the permission of the court, and the duty to account, are monitored following the appointment.
In situations such as old age, illness or prolonged absence, more limited routes, such as the appointment of a trustee (kayyım) or a statutory adviser (yasal danışman) in place of restriction, are also considered.

Processes relating to guardianship, trusteeship and restriction of legal capacity may vary according to the person’s state of health, assets, the applicable legislation and the specific circumstances of the case. It is strongly recommended that the opinion of a legal professional competent in the relevant field be obtained before any act capable of producing legal consequences is carried out. Aslan Law Firm cannot be held liable for any direct or indirect loss that may arise from acts or decisions taken in reliance on the information contained in this content.

Mehmet Göktürk ASLAN, Attorney at Law, is registered with the Istanbul Bar Association. He practises law in accordance with Attorneys’ Act No. 1136 and the Professional Rules of the Union of Turkish Bar Associations. These rules can be found on the website of the Union of Turkish Bar Associations (www.barobirlik.org.tr).
The attorney freely represents the independent defence. He accepts no work that would compromise his professional independence, and bases his assessments solely on the law and the client’s legitimate interests.
Every matter that an attorney learns in the course of his professional duties is covered by attorney confidentiality and may not be disclosed under the Attorneys’ Act. This obligation applies even if you have not instructed the firm; the fact that you have consulted us is also covered.
If the attorney has acted for, or given an opinion to, a party with opposing interests in the same matter, he declines that matter as required by the Attorneys’ Act. He does not act at the same time for persons whose interests conflict. If such a situation arises in an online consultation, the consultation does not take place and the amount you paid is refunded in full.
The website has been prepared solely to provide information, within the limits of the prohibition of advertising in the Attorneys’ Act.
The scope and fee for each piece of work are clearly confirmed to you before work begins; litigation and enforcement work is undertaken under a written engagement agreement. The fee for an online consultation, inclusive of taxes, is shown in the calendar and on the payment screen. In no matter is an attorney’s fee agreed below the current Turkish Attorneys’ Minimum Fee Tariff.
The attorney may give his legal opinion on the likely outcome of a matter; he makes clear, however, that this is not a guarantee, and does not promise any outcome.
If you have a complaint, we ask that you first write to [email protected]; you will receive a reply within 7 days at the latest. Your right to complain to the Istanbul Bar Association, with which the attorney is registered, remains unaffected in all cases.
